Notice of Privacy Practices

How your medical information may be used and disclosed, and how you can get access to it. Effective October 6, 2026.

Please review this notice carefully

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

ZN Dermatology, PLLC ("ZN Dermatology", "we" or "us") is required by the Health Insurance Portability and Accountability Act (HIPAA) and Texas law to keep your protected health information private, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect. Protected health information ("PHI") is information that identifies you and relates to your past, present or future health, the care we provide, or payment for that care. It includes your clinical notes, photographs taken for your care, and your billing records.

How we may use and disclose your health information

We may use and disclose your PHI without your written authorization for the following purposes.

  • Treatment. To provide, coordinate and manage your care. For example, Dr. Nawas may send a biopsy to a pathology laboratory, share results with another physician involved in your care, or send a prescription to your pharmacy.
  • Payment. To bill and collect payment for your care. For example, we may prepare an itemized superbill at your request, submit a claim to Medicare, or confirm coverage with a health plan.
  • Health care operations. To run the practice and keep care safe and high in quality: quality review, training, audits, licensing, business planning and general administration. For example, we may use health information about you to manage your treatment and services.
  • Appointment reminders and communications. We may contact you by telephone, text message, email or the patient portal to confirm or remind you of appointments, to check on you after a procedure, and to tell you about treatment options or services that may be of interest to you. You may tell us how and where you prefer to be contacted, and you may stop text messages at any time by replying STOP.
  • Business associates. We share PHI with companies that perform services for us under written contracts that require them to protect it, such as our electronic health record and patient portal vendor, pathology laboratories, billing and IT services.
  • Family, friends and others involved in your care. Unless you object, we may share information relevant to their involvement with a family member, friend or caregiver you bring to a visit or identify to us. Unless you object, we may also share information in a disaster relief situation.
  • As required by law and for public health. For example, to report certain diseases, adverse reactions to medications or devices, suspected abuse, neglect or domestic violence, or as required by a court order, subpoena or other lawful process. We will also share information with the U.S. Department of Health and Human Services if it wants to see that we are complying with federal privacy law.
  • Health oversight, legal and safety purposes. To health oversight agencies for audits and investigations; to law enforcement as permitted by law; to coroners, medical examiners and funeral directors; for organ and tissue donation; to prevent a serious and imminent threat to health or safety; for workers' compensation; for specialized government functions such as military or national security activities; and to correctional institutions for inmates.
  • Research. Only when an institutional review board or privacy board has approved the research and the safeguards for your information, or with your authorization.

Substance use disorder treatment records. In all cases, including those listed above, if we have substance use disorder patient records about you that are subject to 42 CFR part 2 (the federal confidentiality rule for records of substance use disorder treatment programs), we cannot use or share information in those records in civil, criminal, administrative or legislative investigations or proceedings against you without (1) your written consent or (2) a court order and a subpoena. If 42 CFR part 2 limits how we may use or share those records more strictly than this notice describes, we follow the stricter limit.

Uses that require your written authorization

We will not do the following without your specific written authorization, which you may revoke in writing at any time, except to the extent we have already acted on it:

  • Marketing. Using your PHI for marketing communications, other than face-to-face discussions with you or promotional gifts of nominal value.
  • Sale of your information. We do not sell PHI, and will not without your authorization.
  • Photographs. Clinical photographs are part of your record and are used for your care. Any use of your photographs for education, our website, social media or advertising requires a separate written authorization, which you are free to decline without affecting your care.
  • Psychotherapy notes and other uses not described in this notice.

Your rights

You have the following rights regarding your PHI. To exercise any of them, contact our Privacy Officer using the details at the end of this notice.

  • Inspect and copy. You may see and get a copy of your medical and billing records, usually within 15 business days under Texas law. We may charge a reasonable, cost-based fee. If your records are kept electronically and you ask for an electronic copy, we will provide one in the form you request when readily producible.
  • Request corrections. If you believe information in your record is incorrect or incomplete, you may ask us in writing to amend it. We may deny the request in limited circumstances, and if so we will tell you why in writing and how you may respond.
  • Accounting of disclosures. You may ask for a list of certain disclosures we have made of your PHI in the six years before your request, other than disclosures for treatment, payment, operations and certain others.
  • Request restrictions. You may ask us to limit how we use or share your PHI. We are not required to agree, with one exception: if you pay for a service in full out of pocket and ask us not to tell your health plan about it, we must honor that request unless the law requires the disclosure.
  • Confidential communications. You may ask us to contact you in a specific way or at a specific place, for example by portal message rather than by phone. We will accommodate reasonable requests.
  • A paper copy of this notice. You may ask for one at any time, even if you have agreed to receive it electronically. It is also posted on our website.
  • Notice of a breach. We will notify you if a breach occurs that may have compromised the privacy or security of your PHI.
  • Choose someone to act for you. A person with medical power of attorney or a legal guardian may exercise your rights and make choices about your PHI.

Texas privacy law

Texas law provides additional protections. We do not sell your PHI. We may disclose your PHI electronically to the parties described in this notice, such as laboratories, pharmacies, your health plan and our business associates, in the course of your care and its payment. If you believe your privacy rights under Texas law have been violated, you may also file a complaint with the Consumer Protection Division of the Texas Attorney General at texasattorneygeneral.gov/consumer-protection/file-consumer-complaint. The Attorney General's patient privacy page, texasattorneygeneral.gov/consumer-protection/health-care/patient-privacy, links to a list of the Texas agencies that take health privacy complaints, including the Texas Medical Board, and explains how to file with each.

Our responsibilities

  • We are required by law to keep your PHI private and secure, to give you this notice of our duties and privacy practices, and to follow the notice currently in effect.
  • We will not use or share your information other than as described here unless you tell us we can in writing. If you tell us we can, you may change your mind at any time by letting us know in writing.
  • We reserve the right to change this notice. Changes apply to all PHI we hold, including information received before the change. The current notice is posted in our office and on our website, and a copy is available on request.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us in writing or by phone using the contact details below. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington, DC 20201, by calling 1-800-368-1019 (TDD 1-800-537-7697), or online at hhs.gov/hipaa/filing-a-complaint.
